Obama Violates the Constitution by Issuing an Executive Order on Immigration

In a nationally televised address President Barack Obama announced that he will use executive action on immigration to protect about five million undocumented immigrants from deportation. Ignoring Republicans in Congress and the will of the American people, who voted against his failed domestic and foreign policies as well as his constant violations of the Constitution in the November 2014 mid-term election, he decided to move ahead with unilateral action on immigration.

Obama’s executive order will defer deportations for roughly five million undocumented immigrants whose children are American citizens or permanent residents. Under the president’s plan, the parents must have lived in the United States for at least five years to receive work permits.

Obama’s executive actions will create a major confrontation with Republicans in Congress over the limits of his executive powers. Under the presidential executive fiat, the Obama administration will expand a program that granted certain Dream Act-eligible immigrants a reprieve from deportation, stating that minors who arrived in the nation before 2010 would not face deportation.

Previously, Obama limited such protections to young immigrants who arrived in the country before 2007. The federal government will begin taking applications from undocumented immigrants in the spring 2015.

Ironically, Obama stated previously more than 25 times that as president, he had no authority to change the immigration laws of the nation. He said over and over that it is the Congress who needed to do immigration reform. Obama said he was not an emperor and that the United States is a nation of laws. Of course, he is a liar who will say and do whatever he wants for political reasons. Obama is more than an emperor, he is a dictator!

He acts omnipotent at home while being impotent with our enemies abroad. Obama blamed, as usual, the Republicans in Congress for the failure to enact immigration reform and thus he was forced to act unilaterally.

The fact that Obama has allowed tens of thousands to enter our borders over the last six years endangering our national security never came up in his cynical speech. Hundreds, if not thousands of terrorists, have penetrated our southern border with impunity. Thousands of unaccompanied minors, drug cartel members, and gang members from Latin America have also arrived illegally. Of course, many law-abiding poor immigrants have also entered illegally into our country to seek a better life and they do not threaten our national security. They simply jumped the line ahead of the millions of immigrants who have been patiently waiting for legal approval in their home countries to come to the United States.

One illegal immigrant entered three times without being prosecuted as a felony. The fourth time he entered California, he murdered a police officer. Obama has irresponsibly released from prison thousands of hardened criminals who had entered illegally into our country and many of them committed additional crimes. Obama committed criminal negligence and got away since Congress took no action.

Obama left out of his15-minute speech that during the first two years after his election of 2008, the Democratic Party had control of both Houses of Congress. Obama could have passed any immigration reform law that he wanted without a single Republican vote as he did with ObamaCare. Obama had promised Latinos during the presidential campaign of 2008 that during the first year he would implement immigration reform, but he failed to deliver.

Obama has no intention to work in a bipartisan manner with the new Congress

President Barack Obama has no intention of working compatibly and effectively with the Republicans in Congress. The president has never acted in a bipartisan manner. It has always been his way or the highway. Obama has never reached across the aisle. He has ignore the fact that the Congress is the branch of government who is authorize to change the immigration laws as well as any other laws of our nation.

President Obama is determined not to let the massive defeat of the Democratic Party consume what is left of his presidency and his legacy. Although Obama congratulated Republicans on their election success and offered words of conciliation, he expressed little regret or a sense that he needed to change course.
Obama is playing with matches

Susan Ferrechio wrote an article entitled “Boehner: Obama is going to burn himself on immigration” which was published in The Washington Examiner on November 6, 2014. She explained that Speaker of the House John Boehner, Republican from Ohio, said that the ultimate lesson of the election was that both parties should do more to work together. Speaker Boehner called on Congress to quickly pass an emergency request for funding to combat Ebola, and wanted to ask congressional authorization for the military campaign in Iraq and Syria.

Speaker John Boehner warned President Obama to drop his plans to use executive authority to curb deportations of illegal immigrants. He said the following: “If he continues to go down this path of taking action on his own, it’s inviting big trouble. He’ll poison the well, and there will be no chance of immigration reform moving in this Congress.” Speaker Boehner likened President Obama’s planned move to playing with matches, warning, “He’s going to burn himself if he continues to go down this path.”

Boehner said the nation signaled in the mid-term election that they oppose the president’s plan to take executive action on immigration policy. He added “voters don’t want the president to act on a unilateral basis.”

Voters, Boehner said, “don’t want the president to act on a unilateral basis.” This blanket amnesty would cover millions of undocumented immigrants in the United States, according to Congresswoman Michele Bachmann and said that the amnesty would include illegal Islamic terrorists as well. Bachmann said that this would be exactly what Obama and his handlers want.

At a news conference held on November 6, 2014, involving pro-amnesty Hispanic groups and the two Marxist controlled unions, the AFL-CIO and the Service Employees International Union demanded provide amnesty to more than seven million undocumented immigrants through an executive order.

On the same day an editorial in The New York Times titled “Decision Time on Immigration” stated the following: “Now the election is over, and the only thing to say to the president is: Do it. Take executive action. Make it big. He must not give in to calls to wait.”

This editorial in the pro-Obama newspaper is outrageous and irresponsible since it recommended that the president violate the Constitution by ignoring and bypassing the Congress. This should not surprise anyone since recently The New York Times wrote three editorial recommending lifting the embargo against Cuba unilaterally through executive action, even though it violates the Helms-Burton law, which would be another violation of the Constitution.

Brian Hughes wrote an article entitled “Obama calls immigration action legal, not amnesty” which was published in The Washington Examiner on November 20, 2014. The reporter explained that President Obama stated the following: “I know some of the critics of this action call it amnesty. Well, it’s not. Amnesty is the immigration system we have today — millions of people who live here without paying their taxes or playing by the rules, while politicians use the issue to scare people and whip up votes at election time. Had the House of Representatives allowed that kind of a bill a simple yes-or-no vote, it would have passed with support from both parties, and today it would be the law. But for a year and a half now, Republican leaders in the House have refused to allow that simple vote.”

Republicans stated that Obama will regret going it alone on immigration.

Brian Hughes wrote that Republicans accused the president of killing any hopes of bipartisan compromise on immigration. House Speaker John Boehner stated the following: “Instead of working together to fix our broken immigration system, the president says he’s acting on his own. That’s just not how our democracy works. The president has said before that he’s not [a] king and he’s not an emperor, but he’s sure acting like one. And he’s doing it a time when the American people want nothing more than for us to work together.”

The reporter pointed out that Senator Rand Paul, Republican from Kentucky, said the following: “President Obama is not above the law and has no right to issue executive amnesty. His actions blatantly ignore the separations of powers and the principles our country was founded on. I will not sit idly by and let the president bypass Congress and our Constitution.”

A major challenge Obama faced is convincing the American public of the legality of his actions — he said it is a matter of prosecutorial discretion. Many recent polls have shown that most Americans are opposed to Obama using of executive orders to legislate in violation of the separation clause of the Constitution. Aware of that political reality, Obama will travel to Las Vegas, Nevada on November 21, 2014 to promote his immigration efforts.

Conclusion

Legal immigration is very positive for our nation. Our current immigration system is broken and needs major reform. Obama should have sealed the border completely and then work for a bipartisan immigration reform law in Congress.

By not sealing the border and granting amnesty, millions of people will continue to enter our borders illegally. Obama knows, as do the Marxist unions, that these undocumented immigrants once they become citizens the great majority of them will vote forever for the Democratic Party. Thus, there would be no longer a need for Obama´s followers to commit election fraud as in the past. The Democratic Party will become similar to the PRI in Mexico and rule for many years.

President Obama is not above the law. He is an out-of-control criminal president. According to the separation clause of the Constitution, the Congress writes our laws, not the president. Obama has engaged in an unprecedented power grab that ignores the Constitution, rejects common sense, and ignores the will of the American people.

Obama use of executive orders to unilaterally grant amnesty to millions of undocumented immigrants must be stopped. This unconstitutional action should not and cannot stand. Congress needs to act to defend the Constitution and reject this illegal amnesty plan.The simple fact is that our Constitution has been under serious attack since Obama took power in January 2009.

President Obama and his agencies, cabinet members, and White House czars have been and continue to brazenly violate the Constitution. Congress needs to file a lawsuit against Obama in federal court which eventually will reach the Supreme Court. The nine justices of the Supreme Court need to rule on the legality of these dictatorial executive orders and reverse this unconstitutional overreach by the executive branch. Failure to act will destroy the rule of law in our nation. Already some Republican governors have stated that they will file a lawsuit to stop Obama’s executive orders.

Congress can also use the power of the purse and not fund this unconstitutional executive action. Congress may also consider impeaching this lawless president who has comtempt for our laws and the Constitution.
